In recent years, offshore oil spills frequently causing huge economic losses and serious damages to the environment. This article is aiming to explore China’s marine oil spillage relief mechanism from the respective of the Bohai Sea Oil Spillage. In the first part, author makes a brief introduction of the Bohai Sea Oil Spillage, and points out deficiencies that our government exposed in the accident handling, and analyzes the reasons for the ConocoPhillips China’s arrogance. The second part focuses on the remedies and concretely expanses from the three major litigation paths and the two non-litigious paths, and puts forward the difficulties faced by the five ways. The third part gives a detailed account of the Gulf of Mexico oil spillage. By comparing with the U.S. government’s reaction, the outcome of the claim and the U.S. Oil Pollution Legal System, This part sums up lessons that our country should learn from it. The fourth part comments on the laws and regulations of China’s marine oil spillage relief mechanism. The last part talks about the establishment of marine oil spillage pollution relief mechanism which is divided into:the disclosure of environmental information system, the oil spillage damage assessment system, civil relief program, ACC and government responsibility, the National Ecological Environment litigation and the environmental damages fund.
