On Procuratorial Supervision Of Victim-offender Reconciliation

Recently, With the requirement of repairing social relations and the progress of victim protection consciousness, the judiciary prefers reconciling minor criminal case to resolve social conflicts. In March2012, victim-offender reconciliation was added to the new revised Criminal Procedure Law of the People’s Republic of China. But legal supervision insufficiency leads to infringing upon the will of the parties and social public interests or buying criminal penalty with money. As the legal supervision department, it’s legitimate and feasible for procuratorial organ to supervise the procedure victim-offender reconciliation.The key point of victim-offender reconciliation is the principle of free will, fairness and reconciliation abuse. Procuratorial organ should review both documents and facts to insure the justification and legitimacy of victim-offender reconciliation. At the same time, law should be make to establish the aid system for criminal victims, avoiding the abuse of victim-offender reconciliation.
