Research On Intellectual Property Protection Mode Of Television Program Format

Television program format industry has been a kind of new-born cultural creative industries. However, the development of it has been blocked by the serious copy, so what must be solved is that clearing concept of television program format, formulating discretion standard and setting up relief measures.This paper focus on three main problems:the legal concept and legality of television program format, foreign protection mode of television program format, the perfection of domestic protection mode. Through comparative method, the paper analysis relevant cases to find out the legal status of television program format and the principles of intellectual property protection method in single case. The paper also explore possibilities of providing protection for television program format by neighboring rights and anti-unfair competitions law, which is based on comparison with trade secrets, trademarks and patents and development and innovation demand of this industry. Then the paper makes recommendations for legislature and judicial organ. Finally, the author suggest that intellectual law and anti-unfair competition law should be the primary way to protect television program format; in addition intellectual property management and administration also need to help; besides, legislature judicial organ administrative organ and enterprises all need to shoulder their own responsibilities.The paper aims to help establish a society in which television program format can be fully protected by law, so that relevant issues can be solved effectively, and unfair competition and illegal copy can be restrained and people’s legal rights and interests can be protected. These will benefit the further development and internationalization of television program format industry.
