Exploration And Consideration Of Default Judgment System In China

As an essential part of civil procedure, default judgment system plays an important role in protecting party’s legal right, improving judicial efficiency, defending judicial and national dignity. However, our current default judgment system is not established well enough. There are still some problems, such as unclear legislation concept, rough details and even blank areas. In practice, violation of equality of parties concerned, misunderstanding of property and function about the default judgment occurs. Therefore, to deal with these problems correctly and reasonably is quite meaningful both practically and t theoretically. Our country should establish a corresponding judgment model based on one part debate, accompanied with default judgment. Under this model, we can further improve our default judgment system.
