The legal concept of illegal income is very important because of its frequent usage in the laws and regulations of China, and negative impact on people’s property. The definition of the illegal income is vague, the scope is not clear, and applicable procedures is uncertain and so on, which makes it seems to be very complex and difficult to implement.In order to solve the problem of illegal income, as a health law enforcement officer from the position of health department, I would use semantic analysis, comparative analysis between China and foreign country, learn from other departments’ judicial criteria on illegal income to discuss illegal income problem in administrative aspect in details via three chapters as below:Chapter Ⅰ:Derive the concept of the illegal income from the view of administration by comparing legislation and academic view on illegal income concept; analyze its legal characteristics and related concepts to further clarify its concept.Chapter Ⅱ:Dissect the current situation of the illegal income from the administration point of view and its drawbacks, raise the idea to improve this legal concept.Chapter Ⅲ:Based on the first chapter and second chapter, from the aspect of clear concept of illegal income on administration point of view, definition of constructional scope, applicable procedures on confiscation of large amount of illegal income etc., I propose suggestions and solutions on illegal income concept from the administration point of view.This article, through three chapters, aims to build a comprehensive theory on the illegal income from administrative aspect, which makes administrative enforcement departments have the law to follow and ensure that laws are strictly observed.
