Before" Tort liability law " was promulgated, each districtcourt’s judgments for unidentified object throwing infringement can only be based on“general provisions of the civil law “,“the general principles of the civil lawsuit ofevidence " and “the judicial interpretation of personal injury or damage compensationapplicable law of the Supreme People’s court ". In this case, there are totally differentverdicts for similar cases which seriously affect not only the unity of justice and authority,but also the legal prevention and predictable function. The tort liability law introduced in2009clearly stipulates that it is the possible users of the building who should “give”compensation. With the introduction of the new law, it should have stopped all the debatesand could settle all disputes. However, controversy has not been stopped. Despite of theendorsement of basic legislative concept to relieve the injured party, there are a lot ofdisputes about the specific rules. There are some defects on terms of both entity justiceand operating procedures about this law and it need to be improved, while this law isvaluable and exploratory to distinguish the unidentified tort liability of object-throwing.This thesis first instructs the background, concept and characters of unidentified liabilityfor object-throwing from high building. Secondly, this thesis amply analyzes three similarobject-throwing cases with different verdicts before the implementation “the tort liabilitylaw”. Furthermore, the87thterm of "the tort law" is interpreted in view of the perspectiveof legislation, and deficiencies are explored. Finally, based on the basic viewpoint to reliefof the rights of victims, suggestions are made to undertake unidentified liability ofobject-throwing.
