In modern society, the labor problem is one of the main issues of the society.Among them, the most central one is the labor remuneration. As for the workers, laborcompensation is the protection of the entire family’s basic production. So it is theirfundamental rights and interests. In labor relations, remuneration for the laborers istheir core and essential interests. If there is no guarantee of that right, a series of socialproblem was meant to happen. However, with the flourish of socialist marketeconomy, it is common occurrence to see the facts that people refused to pay theremuneration. This kind of action leads to lots of social problems and affects theconstruction of China’s harmonious society. In this case, the eighth Criminal lawamendment passed in2011set the action of refusing to pay the remuneration as crimeso as to protect the rights of the laborers and promote the stable and harmoniousdevelopment of the society. This paper begins with the paraphrase of refusing to paythe remuneration, discussing the etymologic development of the phrase andcomparing the provision of acts refusing to pay in the criminal law home and abroad.In the second part, the behavioral pattern, the object, the subject and the objective ofthis action is detailed demonstrated through the analyse of the structure of the conduct.In the final part, in order to firmly believe the act, behavior refusing to pay iscompared with the one of expropriation, fraud, refusing to carry out the decision andrefere respectively.
