In China, there is a general lack of awareness about individual privacy. Therefore, the society has not formed such consensus that we should protect minors privacy, and the phenomenon of infringement is quite common. Special legislation for the privacy of minors has not formed a unified system, which is unable to prevent and restrain the infringement, let alone to provide a relief path. In judicial practice, it is difficult to form a unified view on concerning issues, which causes different criteria. In this paper, the author studies the basic theory and system of the minors’ right of privacy based on the results of previous studies. Firstly, this paper makes a definition of the minors’ right of privacy, analyzes its particularity and studies its composition of the privacy of minors from three aspects:subject, object and content. Secondly, the author also makes a comparative study of the relevant systems in common law countries and civil law countries and points out that some foreign legislation can be very useful for China. Thirdly, the author comments on the present situation of the protection of minors privacy, pointing out the limitations which needs further improvement. Finally, the author puts forward some schemes to perfect the privacy of minors in China.
