Recruitment of child soldiers a long time, The Marshall report published in1996attracted the attention of the international community in recent years, the behavior of therecruitment of child soldiers showing a growing trend, many international scholarsinvolved in this field. The international community has gradually increased attention onthis issue and to take certain measures, such as first published the Fourth GenevaConvention prohibits the recruitment of children under the age of15in armed conflict"clearly states, only after the birth of the United Nations Convention on the Rights ofthe Child "Rome Statute" Convention set out to solve this problem.United Nations tosend a special correspondent to participate in the research of the problem, the UnitedNations urged the international community groups to form the alliance to assist therelevant departments to solve the phenomenon of recruitment of child soldiers in theconflict.However, the phenomenon of recruitment of child soldiers do not get effective control,for many reasons, which is inseparable with the special nature of the recruitment ofchild soldiers. First, each country’s history, culture and social environment of the area ofchild soldiers, child soldiers are also different age, age is not the same countries toparticipate in armed groups, resulting in not able to fully constrained from differentparts of the recruitment of child soldiers in international treaties and Statute. Thisarticle describes the legal definition of the concept of child soldiers and the recruitmentof child soldiers were analyzed. How to provide for the recruitment of child soldiers inan international treaty, the state of the behavior in the international judicial practice. Thepaper describes the qualitative behavior of the recruitment of child soldiers as warcrimes according to, followed by the recruitment of children as a crime involving themain legal issues introduced. Finally, how to prevent the crime of recruitment of childsoldiers, the author puts forward a number of recommendations.
