Along with the fastly development of economy and technology, the internet enteredinto the people’ perspective. It gives the enormous economic benefits at the same timehas great influence on the anti-monopoly law regulations. Especially in the recentlyyears, the internet companies abusing of dominant market position occur,fox example,in April2012and then turmoil “3Qwar”,“the Microsoft monopoly case”,“Baiducompetitive ranking case”, and so on.Interests of the multi-level cross a tremendousblow to China’s market economy and the development of the network economy. Internetenterprise has its particularity which has the challenges on regulations. The regulationsand laws have deficiencies on abusing of marker dominance have deficiencies, whichwill cause the public attention on legal problems. Improving anti-monopoly law andregulations, the work become a topic subject.Abroad, the research on the internet enterprise abusing of dominant position isquite deep, especially in Europe and the United states and other developed countries.Not only have theoretical research but also perfect legal system as guarantee. Theresearch become a clue, after the Chicago school jurists Posner’s book (1976)-antitrustlaw. Companies in both Europe and the United states v Microsoft monopoly case,provide a draw on the economic activities.In this paper, according to the analysis of the abusing of dominant position ofregulation in China, a brief introduction to the international organizations, Europe andthe United states, Japan and Germany legislation etc.as a reference through thecomparison it pointed out that China’s current legal system deficiency and can drawlessons from the foreign experience. On this basis, the author gives some advices on theregulation of abusing of dominant position, which specially includes: formulate speciallegislation, establish a responsibility system, and regulatory authorities, and develope amanagement system with Chinese characteristics.
