The Socialization Of Court’s Mediation To Research

The socialization of court mediation is a new mediation system under the judicial philosophy of the moderate socialization of litigation mediation. It not only can alleviate the pressure of court’s work by spliting cases and meet the demand of multiplex dispute settlement, but also acheieve a better collaboration between the court and society for dispute resolution by social forces participating in court mediation. However, the socialitation of court mediation, as a new system, is facing many difficulties in actual judicial practice process. The article will try to put forward conter-measures of perfect socialitation of court mediation through analyzing these difficulties.The full text is divided into introduction, body and conclusion of three parts, the body consis of four parts:The first part introduces the concept of the court mediation and the socialitation of court mediation, and then discusses the causes of the socialitation of court mediation, and then analyses its nature and its contemporary value through its two basic types of the mediation-assisted and mediation-committed. Especially payty-oriented and huge influence from multiplex dispute settlement of the socialitation of court mediation were studied further.The second part introduces the specifical bases and features the socialitation of court mediation which includes mediation-assisted the mediation-committed were analysised. The part examines the real judicial practice model:"people mediation window" of Shanghai Changning District people’s court、the mediation model before litigation in the Chaoyang District people’s court、"filing registration" of HeNan Nan Yang District people’s court and "three adjustable linkage"of HuNan province people’s court. Comparing to the subject of the mediation、procedure、the effectiveness and procedure convergence. This chapter summarizes the common operation features of the socialization of court mediation. The third part analysises the current difficulty of socialization of court mediation. These difficulties includes three faces:theoretical cognition is different, the active and the passive of the judicial power、infringement and security of litigation rights、one and multivariate struggle of the dispute resolution mechanism; system design has flaws, lack of unified legislation norms、convergence adjustment procedure needs to be refined, the applicable scope of case is not clear; practice operation is not standard:social resources use is not balanced、the election and inspection of the mediation is shortage and related security mechanism is not sound. These difficulties has brought great resistance and inconvenience to the development of the socialization of court mediation, but provides a clear direaction to perfect the socialization of court mediation.The fourth part finds the corresponding perfect countermeasures in according to the current difficulty of the socialization of court mediation. Unifying the theoretical cognition:active judicial theory、litigation rights safeguard and principle of multiplex dispute settlement guide the socialization of court mediation. Improving system design of the socialization of court mediation:unified legislation refined procedure convergence and cleared cases scope of the socialization of court mediation. Standardizing the practive operation of the socialization of court mediation:coordinating various social resources to reduce the imbalanced development、setting up the selected mediators mechanism to improve mediator team’s quality and ability and perfecting the effective guarantee mechanism to ensure the socialization of court mediation smoothly work.Sociology of law, the current social management innovation perspective, based on the concept of Judicial Activism Law Theory、the nature of the right to appeal and multiplex dispute resolution mechanism. By demonstrating the legitimacy and necessity of the socialization of court mediation,depthly analysising the difficulties faced in the judicial practice in order to put forward countermeasures to solve these problems, prompting steady development of the socialization of court mediation.
