The Legal Issues Investigative On The Protection Of Workers’Interests Of Bankrupt Enterprises

To workers’,enterprises supported their livelihood.Bankruptcy has threat their survival.Thence,better protection of workers’placement and interests is the point in bankrupt proceedings.In this paper,all points of view are based on The New Bankruptcy Law, combined with the development of Chinese enterprises in different economic environments, investigate the Ministry of Human Resources and Social Security, trade unions, the court how to play a role about protection the workers’rights and interests,make feasible suggestion on improve the protection of workers.The paper is divided into five parts,the main content is as follows:Chapter one elaborate the concept of enterprises bankrupt and workers,the historical development of workers’rights protection and the subordinated relationship of workers’claim and other claim.Illustrate the importance of protecting the workers’interests,bedding for the concrete expansion.Chapter two used three cases of different treatment summed up the features and the court, trade unions made efforts for protection workers’rights.Chapter three lists the problems about protection workers’rights. Respectively before bankruptcy filings,bankruptcy proceedings in progress,after the bankruptcy proceedings,analysis problems that need attention in protection workers’rights.Chapter four is the extraterritorial experience comparative analysis. Respectively from sequencing of labor claims and secured claims,the establishment of the Protection of Wages on Insolvency Found,the social security system,unemployment assistance services.Lists regulations and practices of the developed countries and regions such as the USA,UK,Australia,.Chapter five is the improvement of protection workers’interests.Summary of the issues raised earlier as well as the experience of developed countries and regions and elaborate the supporting system.
