The Anti-Monopoly Law of the People’s Republic of China was formallyimplemented in2008, means that China has reached a new level in the theory ofantitrust law.The next step is the application of the practice and operational areas.Themonopolistic behaviors of China’s banking industry are of particular concerns.China’sstate-owned banks control the vast majority of financial resources and customers.Theunreasonable system of some provisions seriously damaged the interests of thecustomers. After China’s accession to the WTO, the degree of openness of thefinancial sector deepening the growing trend towards foreign banks entering theChina’s financial market, facing the increasingly open competitive situation, we mustregulate the monopolistic behaviors of the domestic banking sector to improvecompetition in the banking market,fine the allocation of resources, and to enhance thecompetitiveness of the banking industry as a whole.This thesis aims to investigate the regulation of China’s banking monopolybehavior. Focusing on the monopolistic behaviors particularly performancing in thebanking sector,especially which behavioes have great impacts on the customers,andhow to regulate these behaviors under the policies and laws.The first chapter of this thesis shows that the purpose of the topic. First reviewthe history of the development of China’s banking industry, then highlight the dangersof monopolistic behaviors of the banking industry, which was analyzed in three main areas. The second chapter is a combination of monopolistic behaviors under thebanking business characteristics,as well as list some cases concerns the behaviors, andthe banking industry regulatory action should be placed on monopoly agreements andthe abuse of dominant position. Chapter three shows how to regulate banks at thisstage of monopolistic behavior,first clarify some basic antitrust concepts, discussspecific regulation with the special nature of the banking industry, such as thedefinition of relevant markets, market dominance and market concentrationdetermination; later argue to clear anti-monopoly law enforcement agencies and theindustry regulator.Also we need to perfect the improvment and intensify lawenforcement on the specific implementation of details to comprehensively guide themonopoly of the banks. The fourth and final chapter put forward the ideas fromanother angle of China’s banking industry behind the appearance of somemonopolistic behavior,bring forward some perspectives in improving thecoordinations of two policies.
