With the continuous increase in the incidents of building collapsing in the recentyears, more and more law scholars begin to study the infringement problems regarding tothe damage caused by such events. Article86of the Tort Liability Act of the People’sRepublic of China, enforced from01/07/2010, has laid down legislations that is more clearand precise than ever concerning problems caused by collapses of any building, structuresor any other facilities. This has reflected indirectly the popularity of the research into thetort liability within these problems. By considering carefully the background and purposeof article86, and combines it with his own knowledge of laws and real life cases, theauthor tries to analyse this topic using different analysing and research approaches.This article is going to talk about the tort liability of the damage caused by collapses ofany building, structures or any other facilities in mainly6different aspects:1. Summary of the tort liability of the damage caused by collapses of any building,structures. Starting from defining building, structures or any other facilities, the author selectsthe main concept and areas of discussion by reading and clarifying article86of theTort Liability Act.2. Related international legislations regarding the damage caused by collapses of anybuilding, structures:The author hopes to gain a more in-depth understanding of the Tort Liability Act ofthe People’s Republic of China through comparisons.3. Responsibility principles of the tort liability of the damage caused by collapses ofany building, structures:The problem that the author wants to discuss the most about, which is emphasizedin this chapter, is the related responsibility principles of article86, its specificapplication values and whether or not it is rational.4. Constituent elements of the tort liability of the damage caused by collapses of anybuilding, structures:By using the classical method of constituent elements to investigate the tort liability,the author aims to gain a more in-depth understanding of the contents of thelegislation and a firm grasp of the key of this discussion.5. Impunity reasons of the tort liability of the damage caused by collapses of anybuilding, structures.
