On The Public Participation In Administrative Laws Legislating

From the new China since its establishment, the administrative laws legislatingactivities in the legislative field are through a change from weak to strong, few tomore, and accounted for the leading position, it made a great contributions to theperfection of China law system. But some of these administrative laws lack of publicparticipation in the process of draft to release. And the imperfect of publicparticipation in administrative legislation made administrative legislating activitieslack of those factors such as, scientific, democratic, universality effectiveness, andwhat public doubt about. Although the process of democracy and the rule of law isspeeding up in China, there is no a specific mechanism process of public participation,and the ways for public to participate in administrative laws legislation are tootraditional, and the administrative legislating institutions are failed to use moderntechnology to broaden the public participation way. What’s more, administrative lawslegislating institutions still in a side of the only big status, and because of the publiclack of legislation initiative rights, private part can not leading the activities ofadministrative laws legislating, the only thing they do is Cooperate withadministrative legislative institutions. Once the administrative laws legislationinstitution don’t disclose the purpose of legislating, the public will doubt and repel theadministrative institution and the laws legislated by administrative institution, it willharm to management of administrative institutions. With the process of the wholenation entering the period of Democratic and law-based society, administrative lawlegislation is playing a important role in China legislating system. From the angle ofthe necessity of public participation, and from the problems of imperfect, lack ofprocess and principles, administrative legislation opaque, public participate rate toolow, public lack of consciousness and ability is insufficient and lack of effectiveinteraction mechanism and so on,lay stress on the analysis of the reasons of theproblem in public participation,and put forward built related system and process toperfect public participation in administrative laws legislating.
