However foreign fishermen illegal fishing has become a city’s ills in the PRD island creek, The event of illegally fishing and violent resistance to lay always happen these years, and the situation become worse and worse. As a result, the study to illegal fishing is significant.The governance of illegal fishing is an administrative enforcement and it has its uniqueness. With the increasing of illegal fishers, especially they escape the fishery by guerrilla, push back law enforcement by self-mutilation. The governance of Illegal fishing has become more difficult, it can’t solve such problem just by stronging the paid force. So that, the governance research for illegal fishing, is not only based the perspective of fishery management, but also Public Administration. In recent years, academic research gradually increased for fishery law enforcement, but most of them are based on the perspective of fishery management. The innovation of this paper is to analyze and solve such problem based on the perspective of fishery management and public andministration, it is significance to enrich the theory of illegal fishing governance and provide the guide for practice.This paper review the governance research of illegal fishing in domestic and international at the beginning, and then introduce the fishery work, analyze the concept and nature of illegal fishing with the aspect of legal and public management. Through sorting out the basic governance of illegal fishing for inland rivers of PRD, analyze the problem and reason deeply for the governance of illegal fishing based on the perspective of fishery management and public administration, raise the solution, evaluate the solution and do feasibility analysis. At last provide the solution of rental of the fishing rights.This paper is not limited to fishery management perspective, but also fishery management and public management perspective, analyze the problem and dig the root cause with both perspective, and then raise the solution. According to the features of PRD:relatively affluent and the fishehman can quit fishing, this paper put forward to rent the fishing rights to foreign fishmen. Make the foreign fishermen to give up the acts of illegal fishing consciously by promoting the ownership mentality and eliminate the tragedy happen again on island rivers.
