The amendments of the the Criminal Code,in1997, established the legislative mode thatcorruption and bribery can apply the same penal provisions that the amount of crime woulddetermine the sentencing grades. To determine the sentencing grades with the amount ofcrime limited the discretion of judge, which facilitated the administration of justice andensured that the provisions of the criminal law could be uniformly implemented across thecountry. However, with the development of our society, the amount is not a good standard toguide sentencing today. There is an explosive discussion on starting amount, sentencingimbalance and separated sentencing of corruption and bribery. The standardization ofcorruption and accepting bribes is not only the urgent needs for bribery and corruption, butalso the strong demand for standardization reform. For this purpose, the article mainlydiscusses the amount and sentencing of corruption and bribes.On this basis, the author willput forward suggestions for improvement. In addition to the introduction and conclusion, thearticle is divided into four chapters, the main contents are as follows:The first chapter introduces the basic meaning of amount and status. It is the fundamentalpart of this study. The legislative history of amount can make us clear the change process,which can help us accurately grasp the historical origins of the current standard amount.The second chapter is a central part of the article. It mainly discusses the problem ofcorruption and bribes in the starting amount. On the basis of the existing main issues ofstarting amount, the author will compare and analysis different theories, and put forward hisown views.The third chapter is another central part of the article. It mainly probe how to make penaltyladder consummate. The same to the third chapter, the author will compare and analysisdifferent theories, and put forward his own views.
