Study On The Problems And Countermeasures Of Guangzhou Quality Supervision Of Administrative Law Enforcement

Since the reform and opening-up, China’s economy has been in a period of rapiddevelopment. The quality problem, which has Relationship with the vital interests of themasses, the survival and development of enterprises, the national image and the healthydevelopment of the whole economic society, has been not only a strategic problem in theeconomic development, but also a political problem which is related to social harmony andsocial stability. China is now committed to improve the livelihood security system and build aharmonious socialist society, therefore the quality is especially important, because whetherthe consumption’s growth or the enterprise’s development can not be achieved without thesupport of the quality. People’s living standards will be improved, when people haveconfidence in the quality of the products on the market and rest assured the safety of life.In recent years the product safety events in China occur frequently, which has becomethe major media headlines, product quality and safety problems have become more and moreserious, therefore the social focus on these issues are unprecedented. The "melamine event"in2008caused a major reshuffle of the national dairy industry, the quality and safety of foodproducts even suffered a serious crisis of confidence. In2012, the "poison capsule" event ofthe leather industry shocked the whole country, the Crisis of confidence which existedpreciously only in food industry, has expanded to pharmaceutical industry. People issued thequestion "what can we eat" one after another. And they almost lost confidence in domesticproducts. The quality supervision departments which are associated with product safety, theproblems of which occur frequently, are pushed by the public opinion to the cusp, especiallythe primary quality supervision departments, which faced the production enterprise directly,have the responsibility to ensure the safety of goods production and regulate the marketeconomy. Because of the frequently occurred product safety accidents, people not only loseconfidence in domestic products but also question the quality supervision departments onhow they exercise their functions and powers. Therefore, a research to the current lawenforcement situation of Guangzhou quality supervision departments is required, so that theexisting problems can be found and analyzed, from the angle of government publicmanagement, a method may also be found to improve the overall level of law enforcement in the quality and technology supervision departments, these initiatives have important practicalsignificance to improve the level of administrative law enforcement in Guangzhou qualitysupervision departments, to promote a better and rapider development of Guangzhou’seconomy, and ensure the safety of people’s life and property.This paper starts from the present situation of administrative law enforcement ofGuangzhou quality supervision Bureau, based on the service type government and the theoryof administration according to law, the problems which exist in administrative lawenforcement of Guangzhou quality supervision Bureau are found, mainly including the lackof law enforcement power and administrative efficiency, the absence of law enforcement andthe conflict in departments, the unreasonable examination and inspection, the strong lawenforcement resistance, the unreasonable compulsory measures. An analyze to theseproblems has also been made, through which6main reasons are found, such as the require ofimprovement in administrative settings, the lack of comprehensive advantages in lawenforcement teams, low operability in some of the law, the unreasonable internal assessmentmechanism, the non-optimal law enforcement environment and the unreasonable inspectionmechanism. On this basis, solutions to improve the administrative law enforcement ofGuangzhou quality supervision Bureau are proposed, which including seven aspects, such asimprove the quality of administrative law enforcement teams, strengthen the trainings, enrichthe equipments and improve the treatments, reform the mechanism of examination, take gooduse of the social forces, realize the harmony law enforcement and increase publicity efforts,in this way a better image of the quality supervision departments can be build, the level oflaw enforcement and the quality of service from the officers can be improved and improvethe effectiveness of the law enforcement and the administration of the quality and technicalsupervision departments.
