September12,2010, after27members of the Basel Committee on BankingSupervision repeated consultations and bargaining for about a year, on the reform ofthe capital requirements of the banking system reached a consensus to form a newprogramme, namely the "Basel Ⅲ".As the most authoritative global financialConvention, the modification of Basel is the largest reform to the regulatory areas ofthe international banking for almost half a century. The main content of themodification covers the core indicators of some aspects, the quality of capital, theminimum capital adequacy ratio, capital components, leverage and liquidity are themost important aspects of this modification.Western developed market economies after long-term exploration and practice,formed a set of effective financial regulatory system and regulatory approachesgradually. Some emerging market economies in the process of reform and openingthe financial system, reformed the existing regulatory system in order to overcomethe financial crisis and to ensure the steady development of the Banking, andachieved remarkable results.Basel Ⅲ has played an important role in the supervision of international banks, theBasel Ⅲ has performed more about the dynamic supervision of banks comparedwith the previous agreement. In the process of the daily management of the bank, theBasel Ⅲ has deepened the supervision and management of the Bank. Basel Ⅲ takesmore stringent standards and regulatory procedures in regulatory capital adequacyratio, and trying to make banking supervision reflects the bank’s business timely. Thepaper discusses the legal implications of the principle of capital adequacy ratio forthe banking supervision, the regulatory external mechanisms for banking supervisionand market discipline mechanisms for banking supervision in detail.The paper analyses the gap between the regulatory status of foreign banks in Chinaand Basel Ⅲ, and gives the advices about the supervision of foreign banks. Thepaper analyses the Basel I, Basel Ⅱ, Basel Ⅲ. Basel should played an moreimportant role in dealing with banking supervision, rules the international financialorder effectively.By analyzing the impact of Basel Ⅲ for the supervision of foreign banks in China,the paper put forwards the revelation of improvement of Basel Ⅲ for the supervisionof foreign banks in China. Combining the impact of Basel Ⅲ, the paper argues that supervision of foreign banks in China must perfect the concept, improve thelegislation of foreign banks, build a more robust oversight mechanism at theinstitutional aspect, and gradually establish a regulatory system, and strengthenmarket cooperation in the supervision of foreign banks, and gradually improve thesupervision of foreign banks in China.
