The word "Intellectual property" was put forward by17century scholar karp zoff, It was well known after the international society established the world intellectual property organization in1967.However the protection of intellectual property rights are not originated in the17th century, it has a long history. Three main contents of Intellectual property rights the patent、trademark and copyright which is origin from feudal monarchy granted privileges, this privilege system extending over several centuries, after the bourgeois revolution led by the bourgeoisie, intellectual property become a kind of civil rights. During the period of transition from freedom capitalism to monopoly capitalism, The international technical trade and international competition have resulted in promoting the internationalization of the protection for intellectual property. At first countries seek intellectual property solutions by signing bilateral agreements, but with the expansion of international trade, the proportion of intellectual products in international trade is more and more big, more and more countries involves, in world intellectual property trade. The international community started to seek a multilateral treaty which union countries to manage the protection of intellectual property. Paris convention and the Berne convention are the first international convention for protection of industrial property and copyright, once two convention became the mainstay of the international system for the protection of intellectual property. More and more treaties related to the protection of intellectual property rights were signed after, it is important for international community to establish the world intellectual property organization to manage the large number of international treaties on the protection of intellectual property rights in1967.the world intellectual property organization was established by international society, International protection system of intellectual property rights is continued perfect under the framework of world intellectual property. However in the20th century. human science and technology has made considerable progress, especially those developed countries who has big advances in science and technology. in order to consolidate their the economic interests brought by high-tech advantages, Developed countries try to increase the protection of intellectual property rights to a higher standard, but they could not finish this ambitious plan under the framework of world intellectual property organization, in October1947, countries signed the general agreement on tariffs and trade, to negotiate lower tariffs among countries, achieve trade liberalization among countries, developed country try to integrated the international protection of intellectual property rights into the trading system. After many years in developed countries and developing countries has play see-saw station on the international standard for the protection of intellectual property in international. As a developing country, China also try to defending the interests of the state from the developed country. After China join the world intellectual property organization in1980s, China has been restricted by the international system for the protection of intellectual property, but the international intellectual property protection system influence by us-led developed countries for a long time, has always been inclined to high standards of intellectual property rights (ip) protection, the developing countries including China are mistreated, China should the establish intellectual property protection system which is suitable for China’s national conditions, balance the interest between international intellectual property system Chinese intellectual property system, implement the national intellectual property strategy and multinational company monopoly laws regulation strategy to cope with the new development of international intellectual property rights protection system.
