No matter how the times developing, people’s life has always been inseparable from the "basic necessities of life" which is the most important for people to survive. But these most basic needs are not always able to be satisfied. Over the years, the housing problems is unprecedented grim, what are the streets talking about is to buy a house, the price of the house, the housing market and other issues. The reasons for this "housing shortage" are complex and diverse, but one reason is certain, that is the imperfect of laws and regulations. All aspects of our society needs laws and regulations to regulate, if the development of them cannot catch the pace with the age, then the specification is lagging and imperfect. And this imperfect can final attributed to the absence of constitutional norms. People first need to have a house, then he can have kinds of rights basis on a house. Our constitution only requires the inviolable rights to the freedom of residential. However, when the citizens even have not got the most basic living accommodation, how can they enjoy those rights which are base on the residence. So, from the human rights perspective, the content of the right to housing in the Constitution must be improved.To study the constitutional protection of the right to housing, we must start from the concept and characteristics of residence, analyze the characteristics of human rights of residence, then come to the conclusion that the residence have the properties of fundamental rights. Then contrast to some foreign countries to get some inspiration. Then analyze the necessity and feasibility of completing our constitutional housing right. And finally on these analysis put forward specific measures to improve our citizen’s right to housing.
