21century is the century of ocean,the Marine economy develops in prosperity.Marine transportation is the important power to promote the development of Marine economy.Pirates around the world especially in the Strait of Malacca, the Gulf of Guinea and the Gulf of Aden as the disharmonious factor in the development of world economy now hinder the normal development of Marine economy.The number of Somali pirate attacks have plummeted as countries dispatched warships and planes to participate in anti-piracy patrols in the Gulf of Aden and Indian Ocean waters of Somalia.But the situation of anti-piracy is still very severe,there still have an upsurge of pirate activities in the Strait of Malacca and the Gulf of Guinea.Combating the pirates effectively need the international cooperation and mutual assistance,the improvement of international treaty and more economic help to poor countries in the end.Under this situation,the author takes The Legal Basis of Combating Crime of Pirates--In the Perspective of Somali Pirates as the paper’s title,hoping that the paper can offer some effective suggestions on combating pirates after studying on the legal basis of combating crime of pirates.The paper consists of four chapters to demonstrate:Chapter One will analyse the necessity and the significance of the legal basis of combating pirates.Chapter Two will give a general introduction about the piracy and Somali piracy,and introduce the Somali Pirates’ rampant situation and reason,then review the historical process of the piracy.Chapter Three will analysis the legal basis of combating pirates from three aspects,including the provisions of the international convention,the United Nations Security Council’s resolutions and Chinese legislation on combating crime of pirates.Chapter Four as the core chapter will put forward the combating legal trouble,point out the problem that the domestic law should make an effective link with the international convention,including the international cooperation on combating crime of pirates.At last,the chapter will propose the specific measures to solve the above problems,advocating to establish a specialized agencies in anti-piracy.
