Research On Improvement Of Public Interest Litigation System In Our Country

With the socio-economic progressing, the problem of infracting the public interest has become increasingly serious, which has become the focus of theoretical research and judicial practice. In foreign country, judicial protection for the public interest has been very mature, and many country have established the civil public interest litigation system to protect the public interest. With the efforts of all sectors of society, our country has also established the civil public interest litigation system. However, our civil public interest litigation system is imperfect, there are still many aspects need to further improve.This article will discuss how to develop our civil public interest litigation system through four parts. Beginning with the emergence and development of the civil public interest litigation system, I has introduced the political, economic and judicial background of the civil public interest litigation system, and the history of the civil public interest litigation system developing. Secondly, I discuss both the public interest and the public interest litigation, and analysis the concept and characteristics of the civil public interest litigation. Also, I give a brief introduction of the extraterrestrial typical civil public interest litigation system, and the value of the civil public interest litigation system. And then, I analysis the legislative and judicial status quo of our country’s civil public interest litigation, and find some deficiency of our civil public interest litigation, such as the scope of the case being too narrow, the parties being improper and the specific program being not perfect enough. According to the preceding discussion, I put forward specific legislative proposals about improving our civil public interest litigation system, which I hope to make up for the deficiency of our civil public interest litigation and protect the public interest.
