Professional sports came into being with the development of market economy.The application of the market rules in the field of professional sports, has also led tothe emergence of professional athletes and professional sports clubs. As an integralpart of professional sports, professional athletes tend to occupy fewer social resources,in a disadvantaged position in the confrontation with professional clubs. Professionalsports collective bargaining system is quite significant not only for professionalathletes, at the same time also significant for the harmonious development of theprofessional sports. Due to the late start of China’s professional sports,there are manydeficiencies in our system comparing with professional sports in the West. Theviolations of the legitimate rights and interests of professional athletes by clubs haveoften occurred. According to the "Labor Contract Law" in China the workers certainlyhave the right of collective bargaining, but in the field of professional sports,professional athletes union has not yet been established, nor the formation ofprofessional sports leagues, professional sports collective bargaining system for ourprofession sports athletes, like the moon in the water, flower in the mirror, in sight butcan not touch. In this paper, through the use of literature research, systems analysis,comparative analysis and other research methods, the author studied on theprofessional sports collective bargaining system, the essential elements of building aprofessional sport collective bargaining system and the status of professional sports collective bargaining in China.Firstly, the definition of professional athletes determines the scope of the subjectof study. Professional athletes as a special kind of workers, their relationship with theclub should be part of a special kind of labor relations. Therefore, professionalathletes should enjoy the right to collective bargaining law.Secondly, the paper makes a systematic introduction to the professional sportscollective bargaining system, procedures of professional sports collective bargainingand the content of collective bargaining contract. Western professional sportscollective bargaining system is quite mature, so there are a lot of valuable referenceexperiences to our professional sports collective bargaining system.Thirdly, the professional sports development status and the problem of buildinga system of collective bargaining in China were analyzed. Because our professionalsport mode is not perfect, a direct result of this is our professional athletes fail toeffectively implement the collective bargaining system, it also caused great harm tothe healthy development of professional sports.Finally, as discussed above, on the basis for China’s current status ofprofessional sports, the paper provides suggestions and ideas about our professionalsports collective bargaining system.
