In the contemporary social conditions, the risk as the basic content andphenomena of social life, becoming a major concern problem for the peopleincreasingly. Side effects brought about by the continuous development of science andtechnology and economic make the human society gradually entering a risk society;while the forces of globalization today is continue to shape a global risk society. Theresearch path that using the view of the internal structure of the social system toexamine the risk phenomenon is opened up by the famous German philosopher,sociologist Ulrich Beck; Beck opens up a unique and innovative perspective toanti-observe the new landscape and the plight of the drawbacks of the contemporaryglobal risk society and makes a comprehensive and profound analysis.The risk society and government functions are closely related. Since the humanentered the risk society, the government is faced with increasing and complicatedproblems. And resolving these problems requires improving its administrativecapacity through the functions of the government reform and administrativelegalization. In this process, the operation of government functions, pathways andperformance will attract people’s attention. Functional behavior and adjustment of thegovernment must take the resection of development status of the risk society and itsobjective law as the basic premise, and on the basis of the mutual interaction of themanagement of social and dynamic balance to better respond to the presence of risksociety and promote social good propulsion. Though the transformation of government functions is not the unique conditions to exclude the hidden dangers inthe risk society, but its role is irreplaceable and the Government has played anindispensable role. The risk society and the transformation of government functionsmutual containing and mutual penetration, the risk society is ever-changing while thefunctions of the government can not stick to the same. They are not a simple linearrelationship, but a characterization relationship. Social risks, the transformation ofgovernment functions will also pose a risk; the government itself may be the sourcesof risk. Only in the mutual interaction and dynamic balance, they can obtain their ownpropulsion. The functions of the government should advance with the times,especially as the administrative law, to make society a better development. However,in real life, the functions of the government in the face of risk are often missing.This article will take the "risk society" theory as view, through empiricalobservation, analysis, and comprehensive study based on previous literature,combined with knowledge of administrative law, sociology, management, politicalscience and other disciplines to cautious look at the linkage mode of the presentgovernment functions performing in the face of the risk society. Trying to start fromthese questions that government how to deal with the challenges of risk society, howto recycling when the government in the face of multiple difficulties brought about bythe risk society, how to promote the transformation of the government, how to create anew government meet the needs of the community of good governance, and how toresolve the "risk" from administrative legal system in the traditional governmentfunctions. In the end, this article will construct the administrative legal system andmechanism compatible with the risk society as the end-result and give somegovernance advice, hoping to initiate, inspire and promote the reform journey of thetransformation of government functions and be helpful to promote the new situationand the ongoing administrative legal reform and the construction of service-orientedgovernment.
