The technology of waterpower andHydropower has been improved greatly, which has reached the international advancedlevel. However, when we develop hydropower with great effort, we must be aware ofthe environmental pressure it brings to us. Attention should be paid to important effectof Environmental Impact Assessment System in the hydropower development. Only ifthe system is implemented, The development of our country’s hydropower could besustainable.Environmental Impact Assessment System is legal means to controlenvironmental pollution and ecological damage at the source,the implement ofEnvironmental Impact Assessment Law has an irreplaceable effect on promoting therational distribution of industry, optimized choice of enterprises’ site and theprevention of potential environmental pollution and destruction caused by thedevelopment and construction of the hydropower. Hydropower is a clean, renewableenergy, encouragement of the development of hydropower is an inevitable choice interms of the share of hydropower in all the energy and the energy structure. Thedevelopment of hydropower in our country is at peak. When we see the enormouseconomic benefits of hydropower development, more attention should be paid toseeing the great impact of hydropower development on the environment and socialinterests rationally.With the setting of market economy system and the popular of theconcept of ruling by law,coordinating these conflicts of interest by administration means become more and more difficult and useless.Therefore, we need to use thelegal to balance these conflicts of interest.By passing legislation to establish thecorresponding mechanism of interest regulation and legal system, we can make theinterest of hydropower development standardized and legalization, in order topromoting the enthusiasm and initiative of different kinds of benefit body inprotecting water resources, prevent and resolve the dispute and realize harmoniousdevelopment between the human and the society and between the human and deenvironment. To achieve these goals,the environmental impact assessment systemshould be established and perfect. There are some successful cases of carring outEnvironmental impact assessment system in hydropower projects, but there are morefailing situations which is embarrassing.Based on the development of domestic and international environmental impactassessment system, the article have understanding of the current situation of it in ourown country and learn from the foreign advanced experience and use it as theguideline to perfect the Environmental impact assessment system in our country. Thearticle is mainly to analyze the effect of carrying out the environmental impactassessment system in hydropower development in China and point out theachievements and shortcomings of it,then expounds in the aspects of improvingpublic participation system, the responsibility and the administrative litigation systemof EIA in order to enrich and improve the legal system of EIA in our country’shydropower development.
