A Research Of Human Rights Protection System In Criminal Justice Of The Suspect And The Defendant

Although the protection of human rights has already integrated into our nation’slaw system, but we still in the odd position of the global law system. Compared withother western countries, our law’s power is still week. But every nation’s situationdrives their reforms direction, we are keeping on learning.We cannot completely fulfill everyone in the adjudgements, the protection ofhuman rights of the suspect and the defendant is as important as the punishment. Thisarticle is based on elaborating the human rights clause from the constitution law andmade a research of protection of human rights system in criminal justice of thesuspect and the defendant, hope that can improve the protection of human rights inour nation.This article concludes four parts. The first part elaborating the human rightsclause from the constitution law, and made explanation for the concepts, attributes ofthe human rights. Then introduce the international mechanisms of the protection ofhuman rights and the international convention of the protection of human rights. Thesecond part made a study on the protection of human rights clause of the suspect andthe defendant from the criminal justice. It takes two ways, the substantial law and theprocedural law, to found the problem in the protection of human rights of the suspectand the defendant. The third part made a comparison of protection of human rightsclause in the criminal justice among the United States, Germany and France. Hopethat we can base on the comparison to learn their advantages and avoid the shortages.In the last part, the article made many suggestions in the criminal justice about the protection of human rights of the suspect and the defendant.This article not only made the suggestions about the protection of human rightsof the suspect and the defendant, but also light the way of the reform of criminaljustice. And the development of the protection of human rights is based on theintrospection of our nation’s law system.
