Intercountry adoption is a way to help many homeless children to find the healthy family bearing for their future lives. But driven by interest, many lawbreakers conduct criminal activities, such as kidnap and sell children internationally after forging the information of homeless children. In order to solve this problem, international organizations and most countries have taken the corresponding measures and brought some positive effects. However, it still has some blind spots and loopholes in the existing supervision of the affairs before placing out children for intercountry adoption. Therefore, it’s necessary to make sure that those children who will be adopted by receiving country get comprehensive protection of interests and perfect existing protection mechanism. Based on analyzing the current situation of "forged homeless children" in sending country, finding the reasons, and studying international cooperation mechanism "Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (Concluded29May1993), Conclusions and Recommendations and Report of the Special Commission on the Practical Operation of the1993Hague Intercountry Adoption Convention (17-23September2005,17-25June2010)", the author puts forward the idea that establishing the integrated laws of supervision before placing out children for intercountry adoption. At the same time, the author also makes suggestion to improve the proactive supervision system in China.The full text of this dissertation consists of text and conclusion, and The Text consists of four chapters:Chapter1is the definition of intercountry adoption, including the definition of sending country, receiving country and supervision before placing out children for intercountry adoption; After analyzing existing supervision before placing out children for intercountry adoption, Chapter2points out defects of the supervision system; Chapter3is divided into three subchapters. Subchapter1conduct study on pertinent regulations of proactive supervision in Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (Concluded29May1993) and Conclusions and Recommendations and Report of the Special Commission on the Practical Operation of the1993Hague Intercountry Adoption Convention (17-23September2005,17-25June2010), including fundamental principle, general requirements, supervision main bodies, procedural requirements. In Subchapter2, the author summarizes the merits of establishing proactive supervision system in respect of Central Authority, Accredited Bodies, receiving country and sending country. In Subchapter3, there are some suggestions which perfect proactive supervision system of placing out children for intercountry adoption; Chapter4points out defects of the supervision system in our country. In this chapter, the author gives advice for perfection of proactive supervision system in China by encouraging domestic adoption, defining power and responsibility of the authorities concerned, establishing accredited bodies in different regions, establishing imperative notary system and regulating charges and fees of intercountry adoption.
