Research On The Administrative Responsibility System In The View Of Administrative Accountability

The administrative accountability system is the core part of the administrative responsibility subject. It’s an important means to supervise and condition the public power operation. For this reason, it is a very important matter in the research of administrative law. The research of administrative accountability in our country is still in its infancy, and there are also many problems in the judgment and investigated of administrative responsibility.This paper discuss the composed elements and responsibility of the administrative responsibility.It will connect the attribution system of administrative accountability with the composed elements of administrative responsibility, and looking for the consistency of their internal elements, through this way that research depth in the composed elements of administrative responsibility area to solve the problem about attribution which we found in the process of administrative accountability. in addition, this paper is also focus on the liability form of administrative accountability, analyze the sustainable impact after the administrative responsibility, to make sure the administrative accountability is not just in the surface. From the structure of this paper, it’s mainly divided into four parts:The first part is about definition of basic concepts, including the conception of administrative accountability and administrative responsibility, it will also to analysis and explain the logical relation between the attribution system of administrative accountability and the composed elements of administrative responsibility.The second part and third part is mainly to deeply study the composed elements of the administrative responsibility. The second part is about the general constitutive requirements of administrative responsibility, including subject element, behavior element, subjective element; the third part is to expound the special constituents of administrative responsibility, including damage result elements and the causal relationship elements.The fourth part mainly introduces the result of administrative accountability, which means the form of liability of administrative responsibility, analysis the current problem of administrative accountability in our country, research the sustainable impact after shoulder the administrative responsibilities, and give the advice about what we should do to perfect our country administration accountability system.
