It is difficult to absolutely avoid war so that the Law of war exists. Where thereis the war, there is necessary to apply rules in the Law of War. It makes a series ofrules to prohibit the use of violence and reduce the bad effects which wars bring atmaximum, and it also contains the principles and rules that prohibit invasions andpunish the war criminals. The Second World War was the largest in the history of thewar, it is the laws of war comprehensive practice provided the unprecedentedhistorical opportunity. At the same time, the laws of war also encountered the mostsevere test.As the initiator of The Second World War, Germany violates a lot of rules in theprocess of apply the laws of war. Prior to The Second World War, under Hitler’sdictatorship, Germany carried out a series of external expansion of their foreign policy,launched a war of aggression, destroyed the world peace and stability and triggeredinternational condemnation. After The Second World War, human beings realized thatthe war can never be solutions to international disputes. From then on, in internationalrelations, all illegal threat, armed intervention, armed offensive or occupation, areillegal and banned. Through a series of invasions and battles, Germany brought greatinjuries to all the human beings. In the early1900s, the Law of War, especially theHague Convention, focused on the governing the methods of fighting and the actionsof combatants, but it paid little attention to the civilians. Nevertheless, the results ofthe Second World War showed that more and more civilians involved into the war.Thus, the countries together brought about the Geneva Conventions to protect thehumanism. After the Second World War, the America, the Soviet Union, the GreatBritain and France took military occupation of Germany. And due to the supervisionand guidance of the allies, Germany has carried out a series of reforms so as to clearup the Nazism and Militarism. All the practice done by Germany after the war offereda lot to the development of the Law.By the laws of war war practice, from the aspect of Germany’s practice duringthe SWW, thus then demonstrates the German war practice indirectly promote thedevelopment of the laws of war.
