Sexual rights is one of the basic human and personal rights, and shouldnot be treated differently because of the male and female gender. With therapid development of society, the continuous improvement of the status ofwomen, and homosexual phenomenon is gradually being recognized, ouracceptance and recognition toward sex has improved significantly. Althoughthe Criminal law is the supreme law stipulates the crime, the criminal liabilityand punishment, there is a serious lag and missing about sexual rights, inparticular the protection of the rights of male sexual. This paper is trying toanalysis the behavior against the rights of male sexual, and the reasons to thecurrent situation of failing to protect the rights of male sexual. Do its best todiscuss the necessity of improving our legislation on the protection of therights of sexual. Combined with the experience of international legislation proposed, this paper is trying to offer some proposal to protect the rights ofmale sexual. First, the women should be brought into the subject of the crimeof sexual so that it will truly achieve equality between men and women;Second, expanded the object of the crime from "women" to "others", the factthat men can also be victims of sexual assault should be emphasized; Third,definite the form of sexual intercourse whether it is concluded in the crime ofrape.
