Research On Safeguarding The Development Right Of Loosely-po Pulated And Scattered Ethnic Groups In China

As all we know that development is the theme of today’s world, in order to seekdevelopment, all countries around the world are paying attention to the declarationand protection of the development right. In our country, the right of development islisted as one of the most important human rights as well as the right of survival. Inorder to protect the right of development, it has been written in the national book-“The National Plan of Human Rights Protection”. Development is the foundation anddriving force of survival. The insurance of the scattered mixed ethnic minorities’rights of development is the interior requirement of constructing a well-off societyand seeking the common prosperity in our country. To insure the realization of thescattered mixed ethnic minorities’ development right will promote the process of awell-off society’s construction in our country. Therefore, this article is beginning withthe research on the present condition of Sang Zhi Xian people’s development right.This article analysis the concept and content of the scattered mixed ethnic minorities’development right and compare it with the development right of the populated nation,and then find the barriers which restrict their rights realization, finally find out thereason and insufficiency of the right of development and discusses on the measures toimprove and perfect the right of development. This article aims to do someexploration on the construction of legal system about the scattered mixed ethnicminority development right in China, thus to insure and promote the all-rounddevelopment of the economy and society around the scattered mixed ethnic minorityarea and guarantee the realization of the comprehensive construction of a well-offsociety in our country.This paper consists of four chapters，the introduction, the basic theory ofscattered mixed ethnic minorities’ development right, the barrier during therealization of Sang Zhi Xian people’s development right and the references，inspiration，countermeasures from the security measures of the minority group’s rightin extraterritorial area. In the introduction，it has mentioned the motive，significance， related literature review，purpose and the main content of this article. In the chapter ofthe basic theory of scattered mixed ethnic minorities’ development right, it hasintroduced the basic theory of development right, the basic living situation of thescattered mixed ethnic minorities and the differences between them and the peopleliving in populated nation who gain autonomy. In the second chapter, it analyses thebasic theory of development right from four parts, such as the era background ofdevelopment right, the meaning of scattered mixed ethnic minorities’ developmentright, the classification of the article content and the current situation of this research.It introduces the basic situation of scattered mixed ethnic minorities by explaining theconcept，the distribution and their distribution characteristics. This paper respectivelycompared the national township areas with the regional national autonomy areas andthe national township areas with the general township areas. In the section about thebarrier during the realization of Sang Zhi Xian people’s development right, byanalyzing the current development, the difficulties and limitations of localgovernment’s action, the author finds out the obstacles of the development right’srealization and then analyzes the reason. Finally, in the countermeasures andmeasures chapter, it separately illustrates the content in three aspects，the idea renewal,the responsibilities of local government and the national support. The idea renewal isdivided into two parts, the renewal of the idea itself and the changes of external idea.The responsibility of local government consists of providing the corresponding policyto support the national development， seeking partnerships to strengthen the regionalcooperation，thinking highly of the non-government organization’s participation andco-operation and carrying out the legal publicity of development right. The nationalsupport includes attaching great importance to the construction of legislation in thescattered mixed ethnic minority area, exploring the judicial guarantee of the scatteredmixed minorities’ right, perfecting the system of law-enforcement in scattered mixedethnic minority areas and creating the legal supervising mechanism which aims toprotect the right of the scattered mixed ethnic minority.The international society has paid more and more attention with the protection ofdevelopment right. Especially when the developing countries confront their development difficulties, the realization of the development right is becomingincreasingly urgent. China, as a developing country which is the world’s largest andmost populous, is in the key period of reform and development. After thirty years ofreform and opening up, although China has achieved great progress in its owndevelopment, at the same time, the gap between rich and poor, different regions anddifferent ethnics are extending. If this gap problem can’t be settled in time, thedevelopment will stagnate and our society will be unstable. Therefore, at thissignificant point, paying close attention to the development right is our primary task.Our country should solve the development problems by institutionalizing China’sdevelopment problems, this is the best way to promote our country’s reform andopening up steadily，and realize the goal of our country’s common prosperity.
