Since the "Human Environment Declaration" was issued, environmental right ofcitizens has gradually become a research topic in the world, and been attached greatimportance by all countries. The environmental problems of our country have beenincreasingly serious, in order to better protect the environment and protect citizens’health, we should put the citizen’s environmental right into the constitution.This paper consists of four parts:The first part is the overview of the citizen’s environmental rights, including thebackground, concept, content, nature and significance of being into the constitution.The second part is the basis of citizen’s environmental rights into constitution,including the theoretical foundation, practical foundation and realistic foundation.The third part is the way of the citizens’ environmental right into constitution. Theway mainly contains the unity of their rights and obligations, the mismatch of theirrights and obligations, the combination of their rights and obligations, and at the sametime we puts forward that the way of combination of rights and obligations should beadopted in China’s point of view.The fourth part is the legal protection of the citizen’s environment right into theconstitution, which could be elaborated from specific environmental rights of therelevant laws and regulations, law protection system of perfecting citizen’senvironmental right, to strengthen the administrative law enforcement ofenvironmental protection, to strengthen the judicial protect environment protection andthe guarantee of citizens effective participation in environmental protection. Whileperfecting the legal protection of civil environmental right system include to establishconstitutional lawsuit system, expand environmental litigation case scope and perfectthe administrative litigation system.
