Faced with a growing real estate price, research on our real estate price control policy,sorting the situation of existing real estate price control on a legal perspective, analysis therationality and validity of the real estate price control policy as well as seeking a path to areasonable policy to bring back a reasonable real estate price which will finally ensure thehealthy development of our real estate market, improve the life quality of our people, and theharmonious development of the social economy.This paper looks into our existing real estate price control policy from the perspectiveof the “new five articles” on a legal basis. The paper cites past policies and analysis theireffect, introducing the contents and characters of the “new five articles”. The measure ofanalysis on social and economic benefits is used to study the effect the social economy afterits implementation. The theoretical research and empirical analysis methods are used toanalyze the effect of the policies in both the theoretical and practice. The suggestion toimprove our existing real estate price control mechanism is finally given based on the above.This paper is composed of three chapters. The first chapter is named as overall researchof the “new five articles”. The author makes an overall review and a deep investigation ontheir effects of the past policies, which proves that the unsatisfied effect of the policies. Aresearch on contents, characters as well as effect to the market of the “new five articles” issubsequently given. The second chapter named as analysis of the legality of the “new fivearticles”, which includes discussion over the following control measures: the administrativemeasures of control, financing measures, land supply measures, tax measures, and relevantdisadvantages inside the measures. Chapter three namely legal advices on perfection of thereal estate price control by establishment of the legal mechanism of real estate control,improvement of the effect of the law and regulations in connection with real estate control inpractice, establishment of the accountability mechanism on real estate price control by thegovernment, to improve the existing control measures mentioned above.This paper, based on the previous researches, systematic and comprehensive exploitsChina’s real estate price control policies, analyzes the existing problems of specific controlmeasures to, puts forward legal advice of the macro-control measures, to make the price ofreal estate of our country is regulation scientific, reasonable and beneficial to the theory andpractice.
