Research On The Dilemmas Of Lawyers’ Ethics

Rapid economic development and globalization led to the development of thelegal profession.，but also to bring a lot of problems, especially the lawyers’ ethicalissues, and the balance between lawyer’s own interests and client’s interests is thefocus of exploring.The lawyers’ ethics is not only related to the credibility and development of thelegal profession, but also related to the development of the lawyers’ system. What ismore, it is an indispensable part of the judicial system. The conflicts of interest are thecore content of lawyers’ ethics. Meanwhile, it’s a very common phenomenon in theprocess of lawyers’ practice. To research on, it is not only help to improve ourprovisions’ existing conditions which are numerous and messy, but also conducive tobuild our lawyer system and realize our judicial justice.This paper starts from the study of lawyers’ ethics, then from discussing thetypes of lawyers’ ethical dilemmas leads to the conflicts of interest. Then furtheranalyze the role obligation and classification of conflicts of interest. On studying thefundamental problems of the lawyers’ ethical dilemmas, clear localization of thelawyers’ role. All of them are for the following writing. Besides the introduction andthe second chapter, the others are base on the relationship between client and lawyer.Through the case introduces the performances of conflicts of interest, and furtherstudy of the theoretical basis of conflict of interest. Through the comparative studyingof the relevant provisions, sum up the resolution rules of conflicts.
