Since China’s reform and opening up, with the rapid development of market economy and the rule of law society constantly improving, China’s focus on the field of higher education also increased. China’s universities also need for the construction of rule of law, and an important part of university regulations is the government by law construction, only according to a chapter of governance in order to build a modern university system, in order to thoroughly implement the independent management rights. University Charter is the fundamental of university system, is of great significance to the establishment of modern university in china. But the construction development of our country’s university regulations lagging behind, there is no strong theoretical guidance and we can learn mature experience. University Statutes still exist many defects and problems. Therefore, this paper mainly uses the text analysis, comparative analysis and literature review and research of the university statutes, main content involves the legal status of university regulations, legal value, legal value, legal defects, proposed consummates our country university statute is made legal advice, and strive for China’s development and improvement of the University Statutes provide some operable theory guidance. This paper is divided into the following four parts:The first part is the introduction. The main description of the relevant legal issues on the constitution of university research objective, train of thought as well as the domestic and foreign literature review.The second part is to sort out the various definitions of Chinese scholars on the articles of association of the University and the definition of the articles of association of the University, and further analyzes the legal deep-seated of University statutes. Mainly discusses the legal status of university regulations, legal value and legal meaning.The third part is the analysis of legal problems on our university regulations. Mainly from the legal perspective points out the legal status of university regulations now prevalent in China is not clear, the legal effect is not high, the lack of legal provisions on procedural issues.The fourth part is on the basis of the above analysis is proposed to perfect the legal suggestions for China University Statutes, in expectation of China University Statute and improvement to provide some help.
