Report On News Tort Liability Exemption

Currently, laws and regulations on news torts are far from enough and thus we could hardly stipulate propagation by news media or protect news organizations and writers. The lagging of news tort liability exemption system leads to limited press freedom and supervision by public opinions could not well play its role. This, hinders the building of a democratic and civilized society. To establish a sound news tort liability exemption system is the call of legislation, legal construction and development of the culture industry. News tort liability exemption has both theoretical and practical bases. In our country, freedom of the press, supervision by public opinions and the public’s right to know are all constitutional rights. Tort defense on news tort liability exemption system is written in constitutional interpretation and numbers of excellent judges have related about it during inquisition. These are all good preparations for liability exemption system. So far, we have seen quite positive study achievements but not systematic enough. This paper is themed on news tort liability exemption system and discusses on the definition, constitutive requirements of news torts and gives suggestions accordingly. The purpose is to enrich current studies and help establish standards. In the long run, it would contribute to a better news environment and development of the culture industry, such as guild on news publish, protect rights of news workers and promote the freedom of the press.
