The legal status of trade associations has been a focus of controversy in academia all thetime. This is especially important in the current context of accelerating the cultivation anddevelopment of social organizations. Then how should we define trade associations and makea clearer distinction among trade associations? What is the social status of trade associationsin our society and how does it function?This article is along such a train of thought to analyze the above-mentioned issues infour chapters. In Chapter One, by analyzing the theoretical summary, originality,characteristics, etc, of trade associations, it is pointed out that the legal status of tradeassociations should not be limited to a department law and should be understood correctlyfrom the reality. In Chapter Two, the existing problems and the cause of them are pointed outthrough the analysis and examination of the current legal status and function of tradeassociations. In Chapter Three, through the comparison with extraterritorial socialorganization and trade association system, I make a point that the legal status of tradeassociations in mainland of China should be repositioned, the juridical person status shouldbe defined explicitly, the internal system should be optimized, the assignment ofresponsibilities should be defined clearly, the legal system should be improved, and thefunction should be innovated. In chapter Four, I point out the necessity of establishing theindependent legal status of trade associations, and propose the content of it. Finally, I putforward some feasible methods of standardizing trade associations to make them playing animportant role of social organizations from both the legislative and the realistic aspect ofestablishing the legal status of trade associations.
