On The Suit Of Revocation Action For The Third Party

The suit of revocation action for the third party is designed to safeguard thelegitimate interests of the third party when adversely affected by the judgementforce.China established the system through “Civil Procedure Code Amendment（2012）”adopted on August31,2012.We mainly draw on the system of France andTaiwan,but they have significant differences.This article analyze the system fromsimilarities to specific provisions,and finally put forward a sound proposal.There arethree parts in the dissertation.In addition to the preamble and conclusion,this paper isdivided into totally five chapter:The first chapter introduces the concept and the features of the suit of revocationaction for the third party.In addition,comparing it with the suit of retrial and the suit ofthe third party dissenting the enforcement to make us more thoroughly understand thesystem.The second chapter introduces the suit of revocation action for the third party ofFrance and taiwan,and they can be provided for the legislative reference.The third chapter describes the background of developing the suit of revocationaction for the third party in our country,including theoretical foundation,legislationneeds and practical reasons.The fourth chapter is a description of China’s relevant laws and regulations,analyzes the provisions of the civil procedure law,question the reasonableness and answer.The final chapter points out how to improve the suit of revocation action for thethird party in our country.To increase the operability of the system,converging withthe suit of retrial on the one hand,establishing supporting system one the other hand.
