In recent years, the demolition becomes a hot topic in the society, while the governmentfunctions in urban land requisition and house dismantlement become the focus of the academe.The presence of government functions is indispensable in the process of urban land requisitionand house dismantlement, because the wide-ranged work which is sticking to the policy andchanges by the time, is extremely complex and systemic. It’s not difficult to figure out thetransformation of Chinese government functions from the view of urban land requisition andhouse dismantlement. It’s our priority to figure out how to position the government rolereasonably, clarify the government’s responsibility and implement the transformation ofgovernment functions in China as soon as possibly during the social transformation period withfrequent contradictions.Since the foundation of the nation, the country’s urban land requisition and housedismantlement has been through four different historical stages which are the institutionalizationof prophase, establishment, adjustment and improvement. Under the guidance of relatedgovernment theory, the role which the government plays in the demolition is transformed fromleading to managing, at last, turning to the place it should be, serving. Although the functions ofthe government in transformation worked in a wrong way, such as offside, dislocation andvacancy, ultimately succeeded in changing to a service-oriented government, a place where itshould be. These changes are clearly realized through the demolish cases, such as the HunanJiahe case, Chongqing most cattle nail house incident and Chengdu Cao Jiaxiang demolition. Inaddition, by reference to urban system of land requisition and house dismantlement of the UnitedStates, Australia, Vietnam, Hong Kong, the government still has much room to improve in thedefinition of the public interest, procedures, compensation and the judicial relief, which for thegovernment, is of great significance to realize the construction of service-oriented government.
