On Some "Procedural Illegal Issues" In Criminal Proceedings

In the criminal justice process in China, owing to the concept of inequality as well as simply punishing the crime of deep-rooted and interference of the Executive, it’s easy to ignore violations of suspects’personal and property rights, judicial procedural justice has been the society’s concern, and it becomes an important criteria for evaluating justice, and one of the important objectives of the reform of China’s judicial system as well.The article consisting of four parts deals with the illegal procedure of the criminal proceedings. The first chapter, reflections on the case situation and the procedural illegal question. The second chapter, criminal procedural law in its manifestations. Primarily a criminal procedure which appears in the various stages of procedural law mainly to conclude and discuss Zhang criminal case. The third chapter, analysis the reason of procedural law. The fourth chapter, proposals of preventing the illegal procedure. One is the analysis of Zhang case intermediate procedural illegal dissection, to reflect the problems of illegal procedure in criminal procedure, and find the reasons from the history and reality; the other tries to put forward the corresponding institutional and operational solutions.
