Legislative Study Of The Reverse Logistics In China

With the accelerated process of industrialization, problems of waste and shortage ofresources and environmental pollution have become increasingly prominent. The countries ofthe world begin to seek out an effective path actively, which is used to cut down on waste andpreserve the ecological environment. Therefore, in order to improve the utilization rate ofresources and reduce environmental pollution and destruction, reverse logistics pay morepeople’s attention gradually. As early as the sixties and seventies in last century, Europe andUnited Sates, Japan and other developed countries have began an in-depth study on reverselogistics, and they recognized it was extremely important strategic significance to sustainabledevelopment. What’s more, they strengthened the relevant legislation and management onreverse logistics to make it become a new growth point of economic development.From the current development of reverse logistics of China, it has got a wide attentionand research by government, academia and enterprise, and has also had some achievements.However, during the process of development, there’re lots of problems as well. On legislation,we only have some informal papers instead of systematic formation of legal norms on reverselogistics, and there’re blanks of legislation in many aspects. On the theoretical research ofreverse logistics, it is late in China compared with foreign developed countries. In the processof practice, due to less attention to reverse logistics by enterprises, lack of reverse logisticstalents, no enough awareness of environmental protection by enterprises and consumers, andlack of higher technological method and management, the development of reverse logistics inour county has encountered bottlenecks. This paper uses the combined methods of theory andpractice, comparative analysis and comprehensive analysis. Starting from the developmentand the present situation of legislation of reverse logistics in China, it demonstrates thenecessity and the feasibility of reverse logistics legislation under analyzing the developmentsituation and the present situation of legislation of reverse logistics in our country, andcombining the experience of reverse logistics legislation in developed countries. Based on thesubject and object of clarity of reverse logistics, it propounds some specific suggestions to ourreverse logistics legislation, and also proposes reverse logistics law. The paper puts forwardthe proposals that the law should follow the guiding ideology, principles of legislation, thebasic framework and content of reverse logistics law and other aspects, in order to improve and perfect the reverse logistics legislation, promotes the development of reverse logistics,and push forward the development of the construction of circular economy in China.
