China’s shipbuilding industry has developed rapidly in recent years, but the shipbuildingenterprises of our country have adopted the general shipbuilding contract of Europe and Japanfor a long time, which is extremely unfavorable to the development of China’s shipbuildingenterprises. In January4,2011, China officially issued the national standard shipbuildingcontract, namely Shanghai standard shipbuilding contract. The contract plays a great role inpromoting the healthy development of China’s shipbuilding industry.Shanghai standard shipbuilding contract has taken full account of new standardslaunched one after another in the international maritime field and the development of thenautical science and technology, drawn on the experience of the standard shipbuildingcontract of Europe, the United States, Japan in the content, combined with the actual situationof the China’s current shipbuilding enterprises, divided shipbuilding contract into six sectionsscientifically including the ship, finance, production, delivery of the vessel, the law,miscellaneous and annex, a total of33terms.Shipbuilding is a complicated and systematic engineering, and the shipbuilding contracthas a large amount, a long construction period. In addition, there is no special provision onshipbuilding contract in our contract law, the theoretical research on Shanghai standardshipbuilding contract is in the initial stage. It makes the correct understanding, learning andusing Shanghai standard shipbuilding contract has become an important task for shipbuildingenterprises. Therefore, it is necessary for us to deeply study the Shanghai standardshipbuilding contract. Be limited by space restriction, this paper focuses on introducing thebackground, significance, characteristics and main content of Shanghai standard shipbuildingcontract, and analyzing deeply terms of ship trial, the liability for breach of contract terms anddispute settlement provisions in the Shanghai standard shipbuilding contract, in order toprovide reference to enrich and perfect the theory of shipbuilding contract.
