Abstract:The relevant literature information resources that referred or quoted in an scientific paper is called references. It is an indispensable part of Scientific papers. The reference marks or lables are those that researcher made for indicating and showing what they readed and quoted when they have been engaged in scientific and technological research, and to distinguish the results of their research from his. Scientific research work has historical inheritance, need the research results of others as a basis, need to read and cite or use the research results of others. Reference is an integral part of scientific research. Reference has different types and values,and it has important function of copyright protection. Standardization and normalization for behavior of references in the academical activities are both a right and obligation to the academical standard requirements, in line with the balance of interests of Copyright fundamental spirit of the legislation requirements. Anomic behaviors on markings of references in scientific papers has violated cataloging rules, standards and academic norms, are misconducted behaviors or an offense relating to the copyright. Anomie violations of references,like reverse quotes, distorted cites, missing quotes,and so on, infringe upon original literature copyright obligee’s legitimate rights and interests,and is the initial root of plagiarism. And it is the scientific misconduct that violates academical norms and rules.It has made the growth of academic fraud and academic corruption and may bring copyright infringement. However, the generation of reference anomie and misconduct are led to by legislation for reference standards, academic evaluation mechanism, regulatory preventive mechanism, efforts to punish responsibility, the legal cultural identity and copyright infringement relief factors.The difficulty of copyright infringement relief is mainly made by the blurring boundaries of copyright and infringe and the confusion to the relationship between establishment of infringement act and doctrine of liability fixation At present, many countries manage to purify academic ecology from the tache o scientific creation by improving the standardized labeling norms for reference of academic system. Thus we can learn from Britain, U.S., and German’s effective practices. This paper recommends to improve external regulation system, such as to complete the contents of the relevant copyright regulation, reference literature behavior standards and norms, regulatory preventive mechanism, academic evaluation mechanism. Meanwhile, emphasize the power of publicity education of research integrity and academic behavior specification, and increasing the actors understanding of the norms and ethical legal consciousness to enhance behavioral self-regulation. Then, to advocate standardization of citing and labeling behavior for reference literature as the creating scientific paper to achieve harmony of legal culture and purification of academic ecology.
