Property shops is a commercial real estate model, which baced on the theory of ownership separation. Owners formed a special legal relationship of condominium ownership by purchasing shops. Traditional condominium ownership focus on all exclusive competence, Property shops owners pay more attention to earnings right. To ensure the realization of the earnings right, Shop owners signed "real estate purchase and sales contracts" and "retail commission lease agreement" at the same time, and entrusted to operators. Through commercial operations and brand management to achieve economies of scale. In practice, property shops projects did not achieve the desired results. On one hand, some shop owners entrusted property type lease agreement, resulting in all the owners investment interests loss; on the other hand the law was not based on nature of the building to make a distinction, absolute protection for the exclusive rights and neglect of the effectiveness owners achieve right. Therefore, in dealing with property disputes style shops, should prohibited minority of owners abuse the exclusive right, restrict the exercise of the exclusive rights and so on. In order to achieve the function of property type shops, we can also innovative ways of utilizing property shops; establishment of condominium ownership deprivation of legal systems. And on this basis to perfect condominium ownership legislation.
