Thought On Improving Legislation Of The Crime Of Sheltering Another Person In Prostitution

The crime of sheltering another person in prostitution refers to provide space for another person to engage in prostitution. Article359of China’s Criminal Law is a rule on this kind of crime and its statutory sentence. However, the opacity of the language in the rule leaves two legal loopholes. One is that the scope of crime is so vague that it even indulges crime; the other is that the statutory sentence is less than scientific, which can’t make the crime properly match the sentence. So it’s urgent to improve legislation of the crime of sheltering another person in prostitution. Two ways are suggested to solve the problem. For one thing, broaden the scope of crime by adding the behavior like masturbation, fellatio, the "mammary intercourse" massage service and the case that involves in homosexual prostitution service into the scope. For another, set the statutory sentence scientifically, like lower the statutory sentence of this case, refine the sentence level, and make the concept of "serious cases" in details.
