Certain Issues And Countermeasure Study On The Ownership System Of Service Invention

The service invention mechanism is the product of social development andprogress of science and technology. The attribution of rights to service invention andprofit distribution thereof have connection with the interests of various partiesincluding the inventor, the enterprise as the inventor’s employer and the whole society.Reasonable ownership system of service invention is helpful for the balance ofdifferent parties’ interests, which not only affects the passion of the investor and theenterprise to engage in creation but also affects the enterprise’s sustainable innovationability and the scientific and technological progress and production efficiency of thewhole society, and will play an important and active role in the creation andimplementation of China’s independent intellectual property rights.The research contents of this thesis focus on the existing rights attributionmechanism of China’s service invention. In addition to the introduction and theconclusion, this thesis mainly consists of three parts. Chapter I of the thesis gives anintroduction to the present status of ownership system of service invention, whichmainly covers the overseas and domestic research summary, the current provisionsand operation situation of Chin’a ownership system of service invention. Chapter II ofthe thesis gives an analysis and discussion on the issues of the current ownershipsystem of service invention, including the rights attribution and profit distribution ofservice invention, the enterprise’ incentive method including the award and remuneration to the inventor, the evaluation and assessment of the service inventionrelated system, and the loopholes in the regulatory system, etc. With respect to theexisting issues, Chapter III of the thesis makes relevant suggestions about China’sownership system of service invention with a view to better promoting theestablishment and improvement of our current service invention system, bettermotivating the enterprise and investor’s enthusiasm to engage in inventions andinnovations, which then promotes the enterprise’s technological innovation andupgrades the technology level of our country.
