Construct Legal Relationship Between Media And Justice

In modern society, the freedom of the press and the judicial independence are the most important two parts of a country. Media and judiciary as two unique social forces, have a common value pursuit. In terms of justice, it through the people’s courts independently officiate the judicial authority to realize judicial justice. In terms of media, it through protecting citizens participate in the events and publish their own views, and supervise the behavior of judicial organs to maintain social order, achieve social fairness and justice. Theoretically, both are in pursuit of social equity and justice, but there exist differences in the running mechanism, so the media often clashed with the justice in practice. Although our country current situation of the relationship between the media and the justice are not serious bad, but not straighten out the relationship between the media and the justice, construct legal relationship between the media and the justice, will seriously hinder legal construction process of our country.Therefore, this thesis regards the construction of legal relationship between the media and the justice as the object of research. This article on the basis of the analysis of China’s national conditions, timely use the some excellent foreign system of other countries for reference, and then puts forward the specific standard and paths of construction of legal relationship between the media and the justice.This thesis including four parts:The first part is the general theories of the media and the justice. It systematically introduced the concept, characteristics, value of media and justice, also introduced the two basic relationship forms between media and justice.The second part analyzes the illegal manifestations and causes of the relationship between media and justice. Firstly, introduces illegal performances of the relationship between media and justice. Secondly, analyze the causes from multiple angles.The third part is the international investigation of the legal relationship between media and justice. It introduces the legislations and practices of United States, Britain and the countries of continental law system. In addition, it introduces the international convention. Investigation by using the method of comparative study on some main countries in dealing with this issue of practice, then sums up the successful experiences for reference.The last part is the legal construction of the relationship between media and justice.First, clear the basic principles and standard of the legal construction of the relationship between media and justice, and then put forward specific paths.
