Parent-child relationship is the premise and basis of determining the rights andobligations between parents, the confirmation of the parent-child relationship has avery important position in the parent-child law, the presumption of the parent-childrelationship, as a confirmation of the parent-child relationship, is important. Aspeople’s idea of love and marriage and life changing perceptions of reality, more andmore constructive about the parent-child relationship emerges in urgent need of asolution of the judiciary. However, China’s civil law has not formed a parent-childrelationship presumed system, resulting in the legislative structure of theparent-child law in China there is a great loophole, also resulted in practice, thesame judgment in the case of the results to differ materially, seriously affect thegeneral public judicial the authority of the trust. Therefore, the parent-childrelationship in law presumption of the system is necessary.This paper, based on the establishment of our own parent-child relationshippresumed system. The main innovations of this paper is that the presumption ofscholars originally separate studies of parent-child relationship and the parent-childrelationship deny together as one, unified planning to become a parent-childrelationship presumed the two parts of the system. Planning reason, the author isdiscussed in the text. Deny another part of the parent-child relationship, I suggestthat the minor children of the same provisions as the estoppels, and reasonableanalysis from the civil law theory about the point of view of the civil rights and civilcapacity, to maximize the maintenance of minor legislation children’s best interests.
