Recently the International Court of Justice made judgment on the dispute betweenSingapore and Malaysia on the case of Pedra Branca, Middle Rocks and South Ledge bythe effective control principle. This judgment furthered the tendency of using the effectivecontrol principle in territorial dispute. Under this circumstances, some countries in SouthChina Sea area stepped up to encroach on PRC’s territory, which makes South China Seaissue became a hot spot around the world.Through the analysis of the statement of the case the International Court judged on in2008, this paper includes how the effective control principle were implemented on thedisputed areas. And then, the next part uses the inclusions to compare the practicesbetween Taiwan and mainland in order to examine whether the practice of PRC is inaccordance with the effective control principle. Through analysis and comparison, thepaper comes up with views and suggestions for future sovereignty practice in the Dongshaislands, the Xisha islands, the Zhongsha islands and the Nansha islands in order to help tosafeguard the territorial sovereignty, maritime rights and interests of our country in SouthChina Sea.
